Terms and conditions of the Dr. Hauschka Friends Program, which can be accessed via the Dr. Hauschka website www.drhauschka.ca

the customer designated in the contract - hereinafter also referred to as "customer" or "friend"

1. Scope of application, definitions

(1) (1) The business relationship between Masson ltd. and the customer in relation to the Dr. Hauschka Friends Program (Loyalty Program) shall be governed exclusively by the following Terms and Conditions of Participation in the version valid at the time the contract is concluded. Deviating general terms and conditions of the customer shall not be recognized unless Masson ltd. expressly agrees to their validity in writing.

(2) The Dr. Hauschka Webshop Terms and Conditions apply to the purchase of Dr. Hauschka products in the Dr. Hauschka Webshop, which is also located on the website www.drhauschka.ca. The Dr. Hauschka Customer Account Terms and Conditions also apply to the Dr. Hauschka customer account, which can be opened free of charge for orders in the Dr. Hauschka Webshop. The Masson ltd. (3)The customer is a consumer insofar as the purpose of the ordered goods and services cannot be predominantly attributed to a commercial or independent professional activity. In contrast, an entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding the contract, is acting in the exercise of their commercial or independent professional activity.

2.Description of the program

The Dr. Hauschka Friends Program offers you the opportunity to connect more closely with us and thereby receive benefits that are reserved exclusively for the Friends community. The Dr. Hauschka Friends Program gives you the opportunity to collect points in the Dr. Hauschka Webshop, particularly on the purchase of goods and/or services, and to redeem these points in various ways (e.g. rewards). The benefits are specially tailored to you. This means, for example, that you can reach different Friends levels based on your purchases in our online store or receive other offers tailored to you (e.g. birthday benefits). Participation is free of charge.

3.Registration and conclusion of contract

(1) Any person over the age of 18 can take part in the Dr. Hauschka Friends program. You can also participate if you are not resident of Canada. In this case, however, you must provide a delivery address within Canada for rewards orders. The prerequisite for participation in the Dr. Hauschka Friends Program is the opening of a customer account, which is regulated in more detail in the Dr. Hauschka Customer Account Terms and Conditions, see Section 1.

(2) You can only register for the Dr. Hauschka Friends Program online via the website www.drhauschka.ca. By clicking on the "Register" button, you submit a binding application to participate in our Loyalty Program. You can change and view the data at any time before submitting the application. By clicking the button, you accept the Dr. Hauschka Friends Program Terms and Conditions of Participation and include them in your application.

(3) Masson ltd. sends the customer an automatic confirmation of receipt by e-mail, in which the registration is listed again. The automatic confirmation of receipt merely documents that the friend's registration has been received by

(5) Participation in the Dr. Hauschka Friends Program is non-transferable. Rewards and non-transferable

4. You can collect points when you buy a Dr. Hauschka product in the Dr. Hauschka webshop. You will receive one point for every dollar of purchase.

(1) Dr. Hauschka points can generally only be granted if you log in to your customer account before completing the payment process in the Dr. Hauschka Webshop. For technical reasons, it is generally no longer possible to grant Dr. Hauschka points after this.

(2) We reserve the right to cancel points that have already been credited if the underlying legal transaction is canceled (e.g. by revocation) or if other conditions for the credit no longer apply (e.g. non-payment for goods purchased).

5. Dr. Hauschka points account and expiry of Dr. Hauschka points

(1) You can check the status of your Dr. Hauschka points account online at any time by logging into your customer account.

(2) We reserve the right to send you the Dr. Hauschka points account balance unsolicited by e-mail, provided you have agreed to this separately, or by post. In this case, we ask you to submit any objections to the accuracy or completeness of the points account balance to us in writing within one month of receipt of the notification. The objection must be accompanied by appropriate evidence, such as a copy of the receipt. If you do not submit objections in good time or in the prescribed form, the notified account balance shall be deemed to have been approved by you. We will draw your attention to this consequence when we send you the account balance.

(3)The points credited expire 36 months after they are issued, and after this period at the end of the fourth quarter (example: If the points were credited on 08.08.2018, they will expire on 31.12.2021). After expiry, Dr. Hauschka points can no longer be redeemed.

6. Redemption of Dr. Hauschka points

(1) The option described below for redeeming Dr. Hauschka points is based on the date of crediting, i.e. points credited first are redeemed first. During the redemption process, you must legitimize yourself as the claimant. This is done exclusively by logging into your customer account.

(2) You can redeem your Dr. Hauschka points for rewards from the Dr. Hauschka rewards store.

7. Termination

(1) You can cancel your participation in the Dr. Hauschka Friends Program at any time without giving reasons and without notice. All you need to do is click on the "Unsubscribe" button provided for this purpose within your customer account.

(2) Should we terminate the contractual relationship with you, we will observe a notice period of four weeks to the end of the calendar month. The right to terminate without notice for good cause (e.g. misuse of the program, fictitious transactions) remains unaffected. We will give notice of termination in writing or by e-mail.

(3)Upon termination of the contract, points that have not yet been redeemed can be redeemed during an expiry period in accordance with the provisions of section 7. This expiry period is 12 months from the date of termination of the contract.

(4) If you participate in the Dr. Hauschka Friends program but wish to cancel your Dr. Hauschka customer account, further participation in the Dr. Hauschka Friends program without a customer account is not possible for technical reasons. Therefore, the termination of the Dr. Hauschka customer account also constitutes the termination of participation in the Dr. Hauschka Friends program. If you still have Dr. Hauschka points credited to your account at the time of termination, you can redeem them in the Dr. Hauschka Webshop within 12 months of your termination taking effect. As it is no longer possible to log in to your Dr. Hauschka customer account after it has been terminated, please send a corresponding request to shopdrhauschka@massonltd.com within this period so that we can activate your account for this purpose. After this period, the points will expire and cannot be reactivated or transferred to another/new account.

 8. Changes to the conditions of participation

(1) We reserve the right to amend these conditions of participation and any supplementary conditions (e.g. for ordering rewards), in particular to adapt them to changed legal and technical circumstances. The current version of the terms and conditions is available online on our website. Changes that are merely advantageous or neutral for you will take effect immediately. The same applies to adjustments that become necessary due to changes in the legal situation.

(2) All other changes not covered by paragraph 1, in particular if they are disadvantageous for you and are not based on a change in the legal situation, shall only become effective for you if we have expressly notified you of the changes and you agree to them or do not object to them within a period of 30 days. If you object, the terms and conditions shall remain valid in their unchanged version. However, we may then make use of our ordinary right of termination. We will point out these consequences again separately in the notification.

9. Liability

(1) Claims for damages are excluded. Excluded from this are your claims for damages arising from injury to life, limb or health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by Masson ltd., its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract.

(2) In the event of a breach of material contractual obligations, WALA shall only be liable for the foreseeable damage typical of the contract if this was caused by simple negligence, unless the customer's claims for damages are based on injury to life, limb or health.

(3) The restrictions of paragraphs 1 and 2 also apply in favor of Masson ltd's legal representatives and vicarious agents if claims are asserted directly against them.

(4) The limitations of liability resulting from paragraphs 1 and 2 shall not apply if Masson ltd. has fraudulently concealed a defect or has assumed a guarantee for the quality of the service. The same applies if Masson ltd. and you have reached an agreement on the quality of the item. The provisions of the Product Liability Act remain unaffected.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

In order to exercise your right of withdrawal, you must inform Masson ltd. of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or e-mail). You can use the attached sample withdrawal form, but this is not mandatory.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.

You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

We do not bear the cost of returning the goods.
